The following information provides a simple overview of what happens to your personal data when you visit this website. Personal data is any data that can be used to identify you personally. For detailed information on data protection, please see our Privacy Policy set out below.

Data Collection on This Website

Who is responsible for collecting data on this website?

Data processing on this website is carried out by the website operator. You can find the operator’s contact details in the section “Information on the Responsible Entity” in this Privacy Policy.

How do we collect your data?

Some data is collected when you provide it to us. This may include, for example, data that you enter in a contact form.

Other data is collected automatically, or with your consent, by our IT systems when you visit the website. This is primarily technical data, such as your internet browser, operating system or the time you accessed the page. This data is collected automatically as soon as you enter this website.

What do we use your data for?

Some data is collected to ensure that the website is provided without errors. Other data may be used to analyze your user behavior. If contracts can be concluded or initiated through the website, the data you submit will also be processed for contract offers, orders or other requests for services.

What rights do you have regarding your data?

You have the right at any time to obtain, free of charge, information about the origin, recipients and purpose of your stored personal data. You also have the right to request that this data be corrected or deleted. If you have given consent to data processing, you may withdraw that consent at any time with effect for the future. You also have the right, under certain circumstances, to request the restriction of the processing of your personal data. In addition, you have the right to lodge a complaint with the competent supervisory authority.

You can contact us at any time with questions about this or other data protection matters.

Analytics Tools and Third-Party Tools

When you visit this website, your browsing behavior may be statistically analyzed. This is done primarily using what are known as analytics programs.

Detailed information about these analytics programs can be found in the following Privacy Policy.

2. Hosting and Content Delivery Networks (CDN)

We host our website content with the following provider:

Shopify

The provider is Shopify International Limited, Victoria Buildings, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland (hereinafter “Shopify”).

Shopify is a tool for creating and hosting websites. When you visit our website, Shopify collects your IP address and information about the device and browser you use. Shopify also analyses visitor numbers, visitor sources and customer behaviour, and compiles user statistics. If you make a purchase on our website, Shopify also collects your name, email address, shipping and billing addresses, payment details and other data related to the purchase (e.g. telephone number, sales amount and similar information). Shopify stores cookies in your browser for its analyses.

For details, please see Shopify’s privacy policy: https://www.shopify.de/legal/datenschutz.

Shopify is used on the basis of Art. 6(1)(f) GDPR. We have a legitimate interest in ensuring that our website is presented as reliably as possible. Where consent has been requested, processing is carried out solely on the basis of Art. 6(1)(a) GDPR and § 25(1) TDDDG, insofar as the consent covers the storage of cookies or access to information on the user's device (e.g. device fingerprinting) within the meaning of the TDDDG. Consent may be withdrawn at any time.

Data processing agreement

We have concluded a data processing agreement (DPA) for the use of the service mentioned above. This is a contract required under data protection law, which ensures that the service processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

The controller responsible for data processing on this website is:

Data retention period

Unless a more specific retention period is stated in this privacy policy, your personal data will remain with us until the purpose for which it was processed no longer applies. If you submit a legitimate request for erasure or withdraw your consent to data processing, your data will be deleted unless we have other legally permissible grounds for retaining your personal data (e.g. tax or commercial law retention periods); in the latter case, the data will be deleted once those grounds no longer apply.

General information on the legal bases for data processing on this website

If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR, where special categories of data under Art. 9(1) GDPR are processed. The following sections of this privacy policy explain which legal bases apply in each individual case.

STARHEAD GmbH

Telephone: +49 (0) 8171 42 88 55 0
Email: datenschutz@starhead.de

Recipients of personal data

In the course of our business activities, we work with various external parties. This sometimes requires the transfer of personal data to these external parties. We disclose personal data to external parties only where this is necessary for the performance of a contract, where we are legally obliged to do so (e.g. disclosure of data to tax authorities), where we have a legitimate interest in the disclosure under Art. 6(1)(f) GDPR, or where another legal basis permits the disclosure. When using data processors, we disclose our customers’ personal data only on the basis of a valid data processing agreement. In the case of joint processing, an agreement on joint processing is concluded.

Withdrawal of your consent to data processing

Many data processing operations are possible only with your express consent. You may withdraw consent you have already given at any time. The lawfulness of data processing carried out before the withdrawal remains unaffected.

Right to object to data collection in specific cases and to direct marketing (Art. 21 GDPR)

IF DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RELEVANT LEGAL BASIS FOR ANY PROCESSING IS SET OUT IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING IS FOR THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION UNDER ART. 21(1) GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR SUCH MARKETING; THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED for direct marketing purposes (OBJECTION UNDER ART. 21(2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of GDPR infringements, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work or the place of the alleged infringement. This right to lodge a complaint is without prejudice to any other administrative or judicial remedy.

Right to data portability

You have the right to receive, or have transferred to a third party, data that we process by automated means on the basis of your consent or in performance of a contract, in a commonly used, machine-readable format. If you request that the data be transferred directly to another controller, this will be done only where technically feasible.

Access, rectification and erasure

Within the scope of the applicable statutory provisions, you have the right at any time to obtain, free of charge, information about your stored personal data, its origin and recipients, and the purpose of the data processing, and, where applicable, the right to have this data rectified or erased. You can contact us at any time about this or any other questions concerning personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You may contact us at any time to do so. The right to restriction of processing applies in the following cases:

  • If you contest the accuracy of your personal data stored by us, we generally need time to verify this. While the verification is ongoing, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was or is unlawful, you may request restriction of data processing instead of erasure.
  • If we no longer need your personal data, but you need it to establish, exercise or defend legal claims, you have the right to request restriction of the processing of your personal data instead of erasure.
  • If you have objected under Art. 21(1) GDPR, a balancing of your interests against ours must be carried out. While it has not yet been determined whose interests prevail, you have the right to request restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data may be processed, apart from being stored, only with your consent, for the establishment, exercise or defence of legal claims, to protect the rights of another natural or legal person, or for reasons of important public interest of the European Union or a Member State.

SSL/TLS encryption

For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the website operator, this website uses SSL/TLS encryption. You can identify an encrypted connection by the browser address bar changing from “http://” to “https://” and by the lock symbol in your browser bar.

When SSL/TLS encryption is enabled, the data you send to us cannot be read by third parties.

Encrypted payment transactions on this website

If, after concluding a paid contract, you are required to provide us with your payment details (e.g. your account number for a direct debit), this data is required to process the payment.

Payment transactions using the standard payment methods (Visa/MasterCard, direct debit) are carried out exclusively via an encrypted SSL/TLS connection. You can identify an encrypted connection by the browser address bar changing from “http://” to “https://” and by the lock symbol in your browser bar.

When communication is encrypted, your payment details sent to us cannot be read by third parties.

4. Data collection on this website

Cookies

Our websites use so-called “cookies”. Cookies are small data files that do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (permanent cookies). Session cookies are automatically deleted at the end of your visit. Permanent cookies remain on your device until you delete them yourself or your web browser automatically deletes them.

Cookies may be set by us (first-party cookies) or by third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services provided by third-party companies into websites (e.g. cookies for processing payment services).

Cookies have various functions. Many cookies are technically necessary because certain website features would not work without them (e.g. the shopping cart function or the display of videos). Other cookies may be used to analyse user behaviour or for advertising purposes.

Cookies that are required to carry out electronic communications, provide certain features you request (e.g. the shopping cart function) or optimise the website (e.g. cookies for measuring website traffic) (necessary cookies) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies to ensure the technically error-free and optimised provision of its services. Where consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out solely on the basis of this consent (Art. 6(1)(a) GDPR and § 25(1) TDDDG); consent may be withdrawn at any time.

You can configure your browser to notify you when cookies are set and to allow cookies only on a case-by-case basis, to accept cookies in specific cases or generally, and to enable the automatic deletion of cookies when you close your browser. Disabling cookies may limit the functionality of this website.

This privacy policy explains which cookies and services are used on this website.

Consent with Complianz

Our website uses Complianz consent technology to obtain your consent to the storage of certain cookies on your device or the use of certain technologies, and to document this in compliance with data protection law. The provider of this technology is Complianz B.V., Kalmarweg 14-5, 9723 JG Groningen, the Netherlands (hereinafter “Complianz”).

Complianz is hosted on our servers, so no connection is made to Complianz’s servers. Complianz stores a cookie in your browser so that the consents you have given, or their withdrawal, can be attributed to you. The data collected in this way is stored until you ask us to delete it, delete the Complianz cookie yourself or the purpose for storing the data no longer applies. Mandatory statutory retention obligations remain unaffected.

Complianz is used to obtain the consent required by law for the use of cookies. The legal basis for this is Art. 6(1)(c) GDPR.

Server log files

The provider of these pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. This includes:

  • Browser type and version
  • Operating system used
  • Referrer URL
  • Hostname of the accessing computer
  • Time of the server request
  • IP address

This data is not combined with data from other sources.

This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website; server log files must therefore be collected.

Contact form

If you send us enquiries via the contact form, we store the information you provide in the enquiry form, including the contact details you enter there, to process your enquiry and in case we have follow-up questions. We do not disclose this data without your consent.

This data is processed on the basis of Art. 6(1)(b) GDPR if your enquiry is related to the performance of a contract or is necessary for taking steps prior to entering into a contract. In all other cases, processing is based on our legitimate interest in effectively handling enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR), if consent has been requested; consent may be withdrawn at any time.

The data you enter in the contact form will remain with us until you ask us to delete it, withdraw your consent to its storage or the purpose for storing the data no longer applies (e.g. after your enquiry has been fully processed). Mandatory statutory provisions, in particular retention periods, remain unaffected.

Enquiries by email, telephone or fax

If you contact us by email, telephone or fax, your enquiry, including all personal data resulting from it (name, enquiry), will be stored and processed by us for the purpose of handling your request. We will not disclose this data without your consent.

The data you send us in contact enquiries will remain with us until you ask us to delete it, withdraw your consent to its storage or the purpose for storing the data no longer applies (e.g. after your enquiry has been fully processed). Mandatory statutory provisions, in particular statutory retention periods, remain unaffected.

Registration on this website

You can register on this website to use additional features. We will use the data you enter for this purpose only to provide the offer or service for which you have registered. All required information requested during registration must be provided in full. Otherwise, we will refuse your registration.

For important changes, such as changes to the scope of our offers or technically necessary changes, we will use the email address provided during registration to inform you.

The data entered during registration is processed for the purpose of carrying out the user relationship established through registration and, where applicable, initiating further contracts (Art. 6(1)(b) GDPR).

We store the data collected during registration for as long as you are registered on this website and delete it afterwards. Statutory retention periods remain unaffected.

5. Newsletter

Newsletter data

If you wish to subscribe to the newsletter offered on the website, we need your email address and information that allows us to verify that you are the owner of the email address provided and that you agree to receive the newsletter. No other data is collected, or it is collected only on a voluntary basis. We use this data exclusively to send the information you have requested and do not disclose it to third parties.

The data entered in the newsletter subscription form is processed exclusively on the basis of your consent (Art. 6(1)(a) GDPR). You may withdraw your consent to the storage of your data and email address and to their use for sending the newsletter at any time, for example by using the “Unsubscribe” link in the newsletter. The lawfulness of data processing operations already carried out is not affected by the withdrawal.

We will store the data you provide to us for the purpose of receiving the newsletter until you unsubscribe from the newsletter, either with us or with the newsletter service provider, and delete it from the newsletter distribution list after you unsubscribe or the purpose no longer applies. We reserve the right to delete or block email addresses from our newsletter distribution list at our discretion, as part of our legitimate interest under Art. 6(1)(f) GDPR.

This does not affect data stored by us for other purposes.

After you unsubscribe from the newsletter distribution list, your email address may be stored by us or the newsletter service provider on a blacklist if this is necessary to prevent future mailings. The data on the blacklist will be used only for this purpose and will not be combined with other data. This serves both your interests and our interest in complying with the legal requirements for sending newsletters (legitimate interest within the meaning of Art. 6(1)(f) GDPR). Storage on the blacklist is not time-limited. You may object to this storage if your interests override our legitimate interest.

Sending newsletters to existing customers

If you order goods or services from us and provide your email address for this purpose, we may subsequently use that email address to send you newsletters, provided that we inform you of this in advance. In such cases, the newsletter will contain direct advertising only for our own similar goods or services. You may cancel your subscription to this newsletter at any time. Each newsletter contains a corresponding link for this purpose. In this case, the legal basis for sending the newsletter is Art. 6(1)(f) GDPR in conjunction with § 7(3) UWG.

After you unsubscribe from the newsletter distribution list, your email address may be stored by us on a blacklist to prevent future mailings to you.

We collect, process and use personal data relating to the use of this website (usage data) only to the extent necessary to enable the user to access the service or to bill for it. The legal basis for this is Art. 6(1)(b) GDPR.

We use payment service providers on the basis of Art. 6(1)(b) GDPR (contract performance) and in the interest of providing a smooth, convenient and secure payment process (Art. 6(1)(f) GDPR). 7. Audio and video conferences

Data processing

We use online conferencing tools, among other means, to communicate with our customers. The tools we use are listed below. When you communicate with us via an audio or video conference over the internet, your personal data is collected and processed by us and by the provider of the respective conferencing tool.

The conference tools collect all data that you provide or use to access the tools (email address and/or telephone number). The conference tools also process the duration of the conference, the start and end times of your participation in the conference, the number of participants and other “contextual information” relating to the communication process (metadata).

The provider of the tool also processes all technical data required to conduct online communications. This includes, in particular, IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or speaker, and the type of connection.

If content is exchanged, uploaded or otherwise provided within the tool, it is also stored on the tool providers’ servers. This content includes, in particular, cloud recordings, chat/instant messages, voicemails, uploaded photos and videos, files, whiteboards and other information shared while using the service.

Please note that we do not have full control over the data processing operations carried out by the tools used. Our options depend largely on the policies of the respective provider. For further information about data processing by the conference tools, please refer to the privacy policies of the tools used, which are listed below this text.

Purposes and legal bases

The conference tools are used to communicate with prospective or existing contractual partners or to offer certain services to our customers (Art. 6(1)(b) GDPR). The tools are also used to generally simplify and speed up communication with us or our company (legitimate interest within the meaning of Art. 6(1)(f) GDPR). Where consent has been requested, the relevant tools are used on the basis of that consent. Consent may be withdrawn at any time with effect for the future.

Data retention period

The data collected directly by us through the video and conference tools is deleted from our systems as soon as you request its deletion, withdraw your consent to its storage or the purpose for storing the data no longer applies. Stored cookies remain on your device until you delete them. Mandatory statutory retention periods remain unaffected.

We have no control over how long your data is stored by the operators of the conference tools for their own purposes. For details, please contact the operators of the conference tools directly.

Conference tools used

We use the following conference tools:

Microsoft Teams

We use Microsoft Teams. The provider is Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland. For details of data processing, please refer to the Microsoft Teams Privacy Statement: https://privacy.microsoft.com/de-de/privacystatement.

The company is certified under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the United States intended to ensure compliance with European data protection standards when data is processed in the United States. Every company certified under the DPF undertakes to comply with these data protection standards. Further information is available from the provider at the following link: https://www.dataprivacyframework.gov/participant/6474.

Data processing agreement

We have concluded a data processing agreement (DPA) for the use of the service mentioned above. This is a contract required under data protection law, which ensures that the service processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

8. Our own services

How we handle applicant data

You can apply to us (for example, by email, by post or via an online application form). Below, we inform you about the scope, purpose and use of the personal data collected from you as part of the application process. We assure you that your data is collected, processed and used in accordance with applicable data protection law and all other statutory provisions, and that it is treated as strictly confidential.

Scope and purpose of data collection

When you submit an application to us, we process the personal data associated with it (for example, contact and communication details, application documents and notes from interviews) to the extent necessary to decide whether to establish an employment relationship. The legal basis for this is § 26 BDSG under German law (initiation of an employment relationship), Art. 6(1)(b) GDPR (general pre-contractual measures) and, if you have given consent, Art. 6(1)(a) GDPR. You may withdraw your consent at any time. Within our company, your personal data is disclosed only to people involved in processing your application.

If your application is successful, the data you submit will be stored in our data processing systems on the basis of § 26 BDSG and Art. 6(1)(b) GDPR for the purpose of carrying out the employment relationship.

Data retention period

If we are unable to offer you a position, you decline a job offer or withdraw your application, we reserve the right to retain the data you have submitted for up to 6 months after the application process ends (rejection or withdrawal of the application), on the basis of our legitimate interests (Art. 6(1)(f) GDPR). The data will then be deleted and any physical application documents destroyed. The data is retained in particular for evidentiary purposes in the event of a legal dispute. If it is apparent that the data will be needed after the 6-month period has expired (for example, because of a pending or anticipated legal dispute), it will not be deleted until the purpose for its continued retention no longer applies.

The data may also be retained for a longer period if you have given your consent (Art. 6(1)(a) GDPR) or if statutory retention obligations prevent its deletion.

9. Our social media presence

Data processing by social networks

We maintain publicly accessible profiles on social networks. The social networks we use are listed below.

Social networks such as Facebook and X can generally analyze your user behavior extensively when you visit their website or a website that incorporates social media content (for example, Like buttons or advertising banners). Visiting our social media profiles triggers numerous data processing operations relevant to data protection. Specifically:

If you are logged in to your social media account and visit our social media profile, the operator of the social media portal may associate your visit with your user account. However, your personal data may also be collected if you are not logged in or do not have an account with the relevant social media portal. In this case, data may be collected, for example, through cookies stored on your device or by recording your IP address.

The operators of social media portals can use the data collected in this way to create user profiles that record your preferences and interests. This allows them to show you interest-based advertising both within and outside the relevant social media profile. If you have an account with the relevant social network, interest-based advertising may be shown on all devices on which you are or have been logged in.

Please also note that we cannot trace all processing operations on social media portals. Depending on the provider, the operators of social media portals may therefore carry out additional processing operations. For details, please refer to the terms of use and privacy policies of the relevant social media portals.

Legal basis

Our social media profiles are intended to ensure that we have as broad an online presence as possible. This constitutes a legitimate interest within the meaning of Art. 6(1)(f) GDPR. The analysis processes initiated by the social networks may be based on different legal grounds, which the operators of the social networks must specify (for example, consent within the meaning of Art. 6(1)(a) GDPR).

Controller and exercise of rights

When you visit one of our social media profiles (for example, Facebook), we and the operator of the social media platform are jointly responsible for the data processing operations triggered by your visit. You may generally exercise your rights (access, rectification, erasure, restriction of processing, data portability and the right to lodge a complaint) either against us or against the operator of the relevant social media portal (for example, Facebook).

Please note that, despite our joint responsibility with the social media portal operators, we do not have full control over the data processing operations carried out by the social media portals. Our options depend largely on the policies of the respective provider.

Data retention period

The data collected directly by us through our social media profile is deleted from our systems as soon as you request its deletion, withdraw your consent to its storage or the purpose for storing the data no longer applies. Stored cookies remain on your device until you delete them. Mandatory statutory provisions, in particular retention periods, remain unaffected.

We have no control over how long your data is stored by the operators of social networks for their own purposes. For details, please contact the operators of the social networks directly (for example, consult their privacy policies, see below).

Your rights

You have the right at any time to obtain, free of charge, information about the origin, recipients and purpose of your stored personal data. You also have the right to object, the right to data portability and the right to lodge a complaint with the competent supervisory authority. You may also request the rectification, blocking or erasure of your personal data and, under certain circumstances, the restriction of its processing.
