General Privacy Notice of Aviano GmbH

General information
Protecting your personal data is a high priority for Aviano GmbH (hereinafter “Aviano”). We want to inform you about what personal data is collected, how it is used and what rights and options to object you have.

  1. Where can I find the information that is important to me?
    This General Privacy Notice provides an overview of the points that generally apply to the processing of your data by Aviano. Further information is available at https://www.aviano.de/datenschutzerklaerung/, where you can also view additional privacy notices from Aviano.

  2. On what legal basis does Aviano process my data?
    We process your data in accordance with European and German data protection laws (the provisions referred to below are those of the European General Data Protection Regulation, or GDPR), and only to the extent and for as long as:
    - it is necessary to perform a contract with you or to take pre-contractual measures at your request (Art. 6(1)(b) GDPR); or
    - you have given consent to the processing (Art. 6(1)(a) GDPR), for example, to receive a newsletter by email; or
    - the processing is necessary to safeguard our legitimate interests or those of a third party, for example, for customer acquisition, marketing and sales, asserting claims, defending against legal disputes, detecting and eliminating misuse, preventing and investigating criminal offences, or ensuring the secure operation of Aviano’s IT systems (Art. 6(1)(f) GDPR); or
    - it is required by law, for example, to retain records for commercial and tax purposes (Art. 6(1)(c) GDPR); or
    - it is necessary in the public interest under Art. 6(1)(e) GDPR, for example, in the context of public services or public health.

  3. What rights do I have?
    You have the right to:
    a) request information about the categories of data processed, the purposes of processing, any recipients of the data and the planned retention period (Art. 15 GDPR);
    b) request the rectification or completion of inaccurate or incomplete data (Art. 16 GDPR);
    c) withdraw consent you have given at any time, with effect for the future (Art. 7(3) GDPR);
    d) in certain cases, request the erasure of data under Art. 17 GDPR, in particular where the data is no longer necessary for its intended purpose or is being processed unlawfully, or where you withdraw your consent (see letter c) or have objected (see letter h);
    e) under certain conditions, request the restriction of data where erasure is not possible or the obligation to erase is disputed (Art. 18 GDPR);
    f) data portability, meaning that you can receive the data you have provided to us in a commonly used, machine-readable format, such as CSV, and, where applicable, transmit it to others (Art. 20 GDPR);
    g) lodge a complaint with the competent supervisory authority about the processing of your data (Art. 77 GDPR). The competent supervisory authority for data protection matters is the Bavarian Data Protection Authority, which you can contact using the following details:
    02-2026 2 / 3
    Bavarian Data Protection Authority (BayLDA)

    www.lda.bayern.de
    Telephone: +49 (0) 981 53 13 00
    Email: poststelle@lda.bayern.de
    h) You also have the right to object, on grounds relating to your particular situation, to the processing of data that is to be carried out on the basis of a legitimate interest under Art. 6(1)(f) GDPR (Art. 21(1) GDPR).
    To exercise these rights, please contact us using the contact details in section 9. The same applies if you have questions about data processing within our company.

  4. Is my data used for advertising purposes?
    Aviano uses your email address to send you information and offers of interest relating to goods or services similar to those you have ordered. You may object to this use at any time by telephone at +49 (0) 89 316 05 96 0, by email at info@aviano.de or by post to Aviano GmbH, Gutenbergstr. 2-4, 85737 Ismaning. This is based on Art. 6(1)(f) GDPR in conjunction with §7(3) UWG.
    We may also send you promotional information by post under Art. 6(1)(f) GDPR in conjunction with §7 UWG, unless you have objected. You may object by telephone at +49 (0) 89 316 05 96 0, by email at info@aviano.de or by post to Aviano GmbH, Gutenbergstr. 2-4, 85737 Ismaning.
    We also use your personal data for advertising only if you have given your consent. You may withdraw your consent at any time with effect for the future. We will inform you of the option to withdraw your consent when we obtain it.
    Different rules may apply when you are online, that is, when browsing our websites. Information about this can be found in the privacy notices for the relevant online service.

  5. How is my data handled when I apply for a job?
    If you send us your personal application documents as part of an application, we process the data you provide solely to conduct the application process and, where applicable, to establish an employment relationship. Your data is stored for as long as necessary to make a decision about your application. If an employment relationship is established, your data will be processed further by Aviano accordingly. If no employment relationship is established, your data will be deleted six months after the application process has concluded. Application documents received by post will be returned in their original form or destroyed after six months. This does not apply if statutory provisions prevent deletion, further storage is necessary for evidentiary purposes, or you have expressly consented to longer storage.

  6. Who does Aviano share my data with?
    We sometimes use external service providers, known as data processors, for example in IT, human resources, financial accounting, sales, marketing, customer service, logistics and printing. As part of providing their services, these processors may also process or access personal data. We have entered into specific agreements with these processors (known as “data processing agreements”). Aviano remains responsible for protecting your data.
    Transfer to other cooperation partners that provide services under their own responsibility for you or in connection with your Aviano contract. This applies if you
    02-2026 3 / 3
    commission such partners to provide services, consent to their involvement, or if we involve them on the basis of statutory authorization.
    In certain cases, we are legally required to transmit specific data to the requesting government authority.

  7. Where is my data processed?
    Your data is generally processed in Germany and the European Union. In exceptional cases, if your data is also processed in countries outside the European Union and the European Economic Area (so-called third countries), this will take place only if you have expressly consented, if it is necessary for us to provide our services to you, or if provided for by law (Art. 49 GDPR). In addition, your data will be processed in third countries only if specific measures ensure an adequate level of data protection, such as an adequacy decision by the European Commission or so-called appropriate safeguards (Art. 44 et seq. GDPR).

  8. How long is my data stored?
    The data subject’s personal data will be deleted or blocked as soon as the purpose for which it was stored no longer applies. Data may be stored for longer if this is provided for by the European or national legislator in EU regulations, laws or other provisions to which the controller is subject. The data will also be blocked or deleted when a retention period prescribed by the aforementioned provisions expires, unless further storage of the data is necessary for entering into or performing a contract.

  9. Who is responsible for data processing? Who should I contact if I have questions about data protection at Aviano or wish to exercise my rights under paragraph 3?
    For all questions relating to data protection, please contact the responsible entity:

    85737 Ismaning
